Terms and Conditions


1. An individual Consultant Account is automatically set up for you at the time your signed Consultant Agreement is received and accepted by the company.  You will be assigned a Consultant ID# at this time to identify your Consultant Account and you will be notified of this number by email and mail. Consultant ID # can not be shared by other individuals.

2. You agree to submit the entire proceeds from your retail sales orders plus sales tax and other charges collected from your customers. The company agrees to receive the proceeds from your retail sales by charging your designated credit card account for cash and checks. Home Gallery Exhibits processes credit card payments from your clients directly. We will include credit card payments from your clients in your total gross sales, itemize which payment is cash or credit and track your total gross sales.  Home Gallery Exhibits will charge your account the agreed upon total of your order per exhibit date and will record this amount in your consultant account.  This establishes tracking of your commissions.  

-The company will deduct the cost of the products you purchase to fulfill your customer’s orders, any hostess gifts, sales aids or promotional items, which you might not have paid for from the credit card account you have authorized. You agree that the company may deduct the total of these charges accordingly.

-Your commissions will be calculated monthly against gross sales, (less tax and your expenses) by your pay level (based on the gross sales amount) and a check will be mailed to you within 30 days of submission.

 3. Each time a payment of commissions is issued to you, you will also receive a complete statement of your consultant account.  It details the compensatable sales, the itemized charges against your account and the amount commissions you earned. Please retain these account statements as a business record for tax purposes.

 4. You agree that your credit card account is the vehicle you have established to assist you in ordering products sold by you, to customers.  Therefore, personal checks from your customers will be made out to you. Credit card charges from your customers will be authorized and charged directly from Home Gallery Exhibits and an account statement of cash, check and credit items will be provided to you on a monthly basis.

You acknowledge that you take title and ownership of the retail products sold to your customers once they are shipped to your hosts and that you transfer title and ownership of the products to the customers when they are delivered to the hostess.

Consultant Debt Policy

 1. A consultant will be placed on certified check/money order only status if:

Certified check/money order only status will remain in effect until the debt is paid in full. Paid within 10 business days; the money order status will be removed on the date payment is received by/and authorization/verification of a new credit card account number.

Paid within 11-30 business days there will be an additional thirty days of money order status from the date of payment by/and authorization/verification of a new credit card account number.

Paid within 31-60 business days there will be an additional sixty days of mone y order status from the date of payment by/and authorization/verification of a new credit card account number.

Debt older than 61 days can result in permanent money order status, closure of your consultant account and the outstanding debt being turned over to an outside collection agency, which could result in legal action.

2. A consultant has multiple return occurrences within a rolling twelve month period. 

If a consultant has six or more return occurrences within a 12 month period regardless of whether the return results in a debt owed to Home Gallery Exhibits each check or electronic check returned is considered an occurrence.

Certified check/money order only status will remain in effect for a period of 120 days from the date of the sixth occurrence if no money is owed to Home Gallery Exhibits.

If a consultant is currently on money order status and has multiple occurrences, permanent money order will remain in effect until the debt is paid in full. At that point a money order status will be assigned for a period of 120 days from the date payment is received.





Applies to all consultants with debt to Home Gallery Exhibits

All commissions will be held and applied to the consultant’s balance until the debt is paid in full.

Monthly invoices are mailed to consultants with a balance due to Home Gallery Exhibits. This balance must be remitted to Home Gallery Exhibits within fifteen days from the date of invoice, unless during those fifteen days the balance is paid in full with commissions.

If a consultant has a bad debt, HGE will hold commissions until debt is paid in full. If debt is not paid within the prescribed regulations, HGE reserves the right to retain funds not remitted to consultant in an attempt to reimburse Home Gallery Exhibits

YEAR END TAX REPORTING

All consultants with HGE are independent contractors, not employees. The company will not issue a W 2 tax form at the end of the year but will send you a Form 1099 if one is necessary.  A 1099 is a tax form required by the IRS for independent contractors

What does it mean to be an independent contractor?

When you sign your consultant agreement, you agree that you are an independent business person.  As such, you:



Independent Consultant Agreement

This is an Agreement between Home Gallery Exhibits and the aforementioned consultant.

The company agrees to establish a consultant account at the time a signed independent consultant agreement package is received and accepted. The consultant agrees that he/she is an independent contractor for Home Gallery Exhibits and will be compensated only according to the agreement. The Consultant agrees that the Consultant Account is subject to the terms and conditions stated in the consultant agreement. The Consultant understands and agrees that the plan and processes of Home Gallery Exhibits are subject to change upon notification from Home Gallery Exhibits. The Consultant’s continued sales activity of Home Gallery Exhibits’ products confirms and acknowledges his/her agreement to the changes.

The consultant is responsible for submitting all monies due to the company within 5 business days after each exhibit. Failure to comply with this requirement may result in collection proceedings, closure of the consultant account and termination of the agreement between Home Gallery Exhibits and Consultant within 10 business days from receiving written notification from the Home Gallery Exhibits.

The Consultant agrees that he/she is an independent business person free to conduct business according to his/ her own methods while incorporating the company recommended guidelines and procedures concerning product representations, and other promotional or incentive programs. The consultant further acknowledges and agrees that he/she is not an agent  or employee of Home Gallery Exhibits and will not be treated as such  for any Federal, State or Local Income Tax, Withholding Taxes, Workers’ Compensation ,Unemployment Compensation ,Social Security or any other tax that might be associated with an employee.

The Company will only make commission payments on orders paid in full.  The Company is not liable for orders it is unable to fill. Home Gallery Exhibits shall be held harmless of any violations or unlawful conduct and/or practices by the Consultant, which are contrary to terms and intentions stated in this agreement.

The consultant may use the name Home Gallery Exhibits while this agreement is in effect, according to the terms and conditions presented.  The consultant is not authorized to use Home Gallery Exhibits’ artwork, prints, trademarks, copyrighted material, logos or other registrations in any other venue.

If the consultant terminates or is terminated from association with Home Gallery Exhibits for any reason, the Consultant agrees to cease immediate use of the Home Gallery Exhibits name or any other company designations for any purpose whatsoever.  The Consultant agrees to conduct him/herself lawfully and with utmost integrity in every transaction and interaction as a Home Gallery Exhibits Consultant. 

The consultant will only engage in fair and lawful business practices, and will present Home Gallery Exhibits and its products in a truthful and honest manner.  The Consultant agrees that any ideas submitted to the company are done so without expectation of compensation from the Company.

The consultant’s association as an independent contractor with Home Gallery Exhibits will remain in effect until termination of this agreement by either party for any reason by giving 10 days written notice. This agreement shall become effective upon receipt from applicant when acknowledged by authorized of Home Gallery Exhibits personnel.
